CounselConnect is a technology platform that facilitates connections between legal professionals. We are nota law firm, employer, event organiser, financial institution, escrow service, or agent of any user. All interactions, transactions, and engagements between users are conducted at their own risk. Please read this Safety & Disclaimer Policy carefully.
1. General Platform Disclaimer
CounselConnect is a technology platform that provides tools for legal professionals to connect, collaborate, and transact. We do not practise law, provide legal advice, supervise legal work, guarantee the quality of any services, or act as an agent, employer, or representative of any user. All engagements, transactions, and interactions facilitated through the Platform are entirely between the participating users.
By using the Platform, you acknowledge and agree that:
You interact with other users at your own risk;
CounselConnect does not screen, vet, or endorse any user, their qualifications, or the quality of their services;
LSK verification on the Platform confirms only that a registration number was valid at the time of verification, not that the advocate is currently in good standing or competent in any area;
You are solely responsible for conducting your own due diligence before entering into any engagement;
CounselConnect is not liable for any loss, damage, or harm arising from your interactions with other users.
2. Jobs & Briefs Safety
When posting or accepting briefs on the Platform, follow these safety guidelines:
Before Engaging
Verify credentials independently. Check the advocate's current practising certificate status directly with the Law Society of Kenya. The Platform's verification badge indicates a point-in-time check only.
Check ratings and reviews. Review the advocate's job completion history, ratings, and reviews from other users.
Use written engagement letters. For all substantive matters, execute a formal engagement letter or brief instruction outside the Platform that clearly sets out: scope of work, deadlines, fees, confidentiality obligations, and reporting requirements.
Verify professional indemnity insurance. Confirm that the advocate you are engaging maintains adequate professional indemnity insurance cover.
Platform Limitations
CounselConnect does not guarantee the quality, timeliness, accuracy, or completeness of any work performed under a brief;
CounselConnect is not liable for missed court dates, filing deadlines, malpractice, or any adverse outcomes;
Fee suggestions provided by the Platform are indicative only and do not bind either party;
Malpractice liability rests solely with the performing advocate;
Payment disputes between parties are resolved between the parties, not by CounselConnect.
Confidentiality
You are solely responsible for handling confidential case information in accordance with your professional obligations under the Advocates Act and the LSK Code of Conduct. The Platform does not provide end-to-end encryption for job-related communications. Use secure, external channels for sharing sensitive case materials.
3. Mentorship Safety
What Mentorship Is
Mentorship on CounselConnect is professional guidance and knowledge-sharing between legal professionals. It is an educational and advisory relationship.
What Mentorship Is NOT
Legal advice or legal representation;
An advocate-client relationship;
A guarantee of career outcomes, professional advancement, or specific results;
A substitute for independent professional judgment;
An endorsement of the mentor's expertise by CounselConnect.
Safety Guidelines
Verify mentor qualifications independently. Check the mentor's profile, reviews, and credentials. CounselConnect does not certify mentor expertise.
Independently verify information. Any advice, guidance, or information received during mentorship should be independently verified before acting on it.
Virtual sessions. For virtual mentorship sessions, you are responsible for ensuring a secure internet connection and environment. CounselConnect is not liable for technical issues on your end.
Report concerns. If a mentor provides advice that you believe is harmful, unethical, or unprofessional, report it through the Platform and, if appropriate, to the LSK.
4. Events Safety
In-Person Events
Attend at your own risk. CounselConnect does not vet venues, organisers, or speakers.
Personal safety. You are responsible for your own safety, health, and property at all events. Take reasonable precautions when attending events with people you do not know.
Health protocols. COVID-19 and other health protocols are the organiser's responsibility. Assess your own health risk before attending.
Transportation. Plan your own safe transportation to and from events.
Verify event details. Confirm the event date, time, venue, and organiser details independently before attending.
Virtual Events
You are responsible for your own technology, internet connectivity, and data security;
CounselConnect is not liable for technical issues or disruptions during virtual events;
Be cautious about sharing screen content that includes confidential information.
Platform Disclaimers
CounselConnect is NOT liable for:
Injuries, illness, property damage, theft, or assault at events;
Inaccurate event information provided by organisers;
Cancellations, changes, or poor quality of events;
The accuracy of speaker presentations or event content;
Food safety or catering quality at events;
Any other harm arising from event attendance.
5. Peer-to-Peer Payments
General Payment Safety
All peer-to-peer transactions are at your own risk. CounselConnect does not hold funds in escrow, act as a payment intermediary for direct transactions, or guarantee that payment will be made or received.
Verify payment details independently. Before sending money via M-Pesa, confirm the recipient's name and number independently. Do not rely solely on details posted on the Platform.
Never share your M-Pesa PIN or other payment credentials with anyone, including other users or anyone claiming to represent CounselConnect.
Be wary of advance payment requests. Exercise caution when asked to pay in advance for services, especially from users you have not previously engaged.
Keep records. Save all transaction confirmations, M-Pesa messages, and payment receipts. These may be needed in case of disputes.
Verify M-Pesa confirmation codes. If another user provides an M-Pesa confirmation code as proof of payment, verify it through your own M-Pesa records or by contacting Safaricom.
Red Flags
Requests to pay via unusual or untraceable methods;
Requests to send money to a third party on someone's behalf;
Pressure to pay immediately or urgently;
Payment amounts that don't match the agreed fee;
Requests for personal financial information beyond what is needed for the transaction.
6. Marketplace Safety
For Buyers
Inspect before paying. Always inspect goods in person before making payment. Do not pay for items you have not seen or verified.
Meet in safe, public locations. Conduct in-person transactions during daylight hours in well-populated areas.
Verify seller identity. Confirm the seller's identity and ownership of listed items.
Be sceptical of unrealistic prices. If a deal seems too good to be true, it probably is.
Request documentation. For property, vehicles, or significant assets, request and verify all relevant documentation (title deeds, logbooks, etc.).
For property: Conduct a thorough background check. Revisit the location, speak to neighbours and security personnel, confirm ownership, and verify whether the property is genuinely for sale or rent.
For Sellers
Provide accurate, truthful descriptions and pricing;
Only list items for which you have legal title;
Meet buyers in safe locations;
Verify payment before releasing goods.
Platform Disclaimers
CounselConnect does not verify listings, guarantee item condition or availability, provide buyer/seller protection, or act as an escrow service. All marketplace transactions are solely between the buyer and seller.
7. Fundraising & Condolence Safety
Before Contributing
Verify the fundraiser's legitimacy. Independently confirm the purpose, the organiser's identity, and the beneficiary. CounselConnect does not verify fundraiser claims.
Confirm payment details independently. Before sending money via M-Pesa or bank transfer, verify the account details through a separate channel (phone call, in-person).
Be cautious of emotional manipulation. Scammers may exploit emotional situations (funerals, medical emergencies) to solicit funds fraudulently.
Understand that contributions are non-refundable. Once sent, contributions cannot be reversed through the Platform.
No tax deduction guarantee. CounselConnect does not provide tax receipts. Verify with a tax professional whether your contribution qualifies for any tax benefits.
For Organisers
Post truthful, accurate information about the purpose and beneficiary;
Obtain consent from the deceased's family before posting condolence information;
Provide correct payment details;
Use contributed funds for the stated purpose;
Be prepared to account for the use of funds if requested by contributors.
Platform Disclaimers
CounselConnect does not audit fund usage, verify beneficiary identity, act as a financial intermediary, or guarantee that funds reach the intended purpose. Report suspicious fundraisers immediately.
8. Messaging Safety
Confidentiality Warning
IMPORTANT: Messages on CounselConnect are NOT end-to-end encrypted. Messages are stored on Platform servers and may be accessed by authorised Platform personnel for safety, compliance, and enforcement purposes. Do NOT share confidential client information, privileged legal communications, or sensitive case details through Platform messaging without implementing independent security measures.
Safety Guidelines
Report harassment immediately. If you receive threatening, abusive, or harassing messages, report them through the Platform and block the sender.
Do not click suspicious links. Treat links from unknown users with caution. They may lead to phishing sites or malware.
Verify identity for sensitive discussions. Before discussing sensitive matters, verify the other user's identity through an independent channel.
Message deletion is audited. Deleted messages are logged for safety and compliance purposes.
9. Feed & Content Safety
Content Accuracy
Verify before relying. Posts, articles, questions, answers, and other content on the Platform are peer-generated and have not been verified by CounselConnect. Always independently verify legal information before relying on it professionally.
Not legal advice. Content on the Platform (including articles, Q&A answers, and comments) does not constitute legal advice unless the author explicitly assumes responsibility as such. No advocate-client relationship is created through content interactions.
Algorithmic feed. Content in your feed is ordered by an algorithm, not by editorial judgment. Appearing in your feed does not constitute an endorsement by CounselConnect.
Trending content. Trending topics and posts are determined by automated engagement metrics, not editorial curation.
Polls
Poll results are informal, non-scientific, and non-binding. The Platform cannot guarantee poll integrity or prevent manipulation. Do not rely on poll results for professional or business decisions.
Report Harmful Content
If you encounter content that is inaccurate, misleading, defamatory, harmful, or violates our Community Guidelines, use the in-app reporting feature. We review all reports and take action where appropriate.
10. Groups & Channels Safety
Moderators are users, not Platform staff. Group and channel moderators are fellow Members. Their actions do not represent CounselConnect's views or policies.
Do not share confidential information. Even in "secret" or "closed" groups, you cannot guarantee confidentiality. Other members may screenshot, copy, or share content outside the group.
Verify identity independently. In closed or secret groups, verify the identity and credentials of other members before sharing sensitive information.
Report misconduct to the Platform. If group or channel moderators are not addressing harmful behaviour, report it directly to CounselConnect support — not just to group admins.
CounselConnect may dissolve groups. We reserve the right to close groups or channels that violate our Terms of Service or Community Guidelines.
11. Professional Conduct
As a platform for legal professionals, CounselConnect users must uphold the highest standards of professional conduct:
Legal & Regulatory Obligations
Advocates Act (Cap 16): All advocates must comply with the Advocates Act and its subsidiary legislation at all times when using the Platform.
LSK Code of Conduct: The LSK Code of Conduct and professional ethics rules apply to all interactions on the Platform, including advertising, solicitation, and client relations.
Touting & Solicitation: The prohibition on touting and improper solicitation of clients under the Advocates Act applies to Platform activity. Do not use the Platform to tout for clients in violation of professional rules.
Client Confidentiality: Your obligations regarding client confidentiality and legal professional privilege survive all Platform interactions. Do not post, share, or discuss confidential client information on the Platform.
Professional Indemnity Insurance: Advocates offering services through the Platform should maintain adequate professional indemnity insurance as required by the LSK.
Anti-Money Laundering: Users must comply with all applicable anti-money laundering laws and regulations, including the Proceeds of Crime and Anti-Money Laundering Act, 2009.
Skill endorsements and vouches are not credentials. Endorsements and vouches from other users are peer opinions. They do not replace formal credential verification, professional certification, or character references.
12. Fraud & Scam Prevention
Common Scams to Watch For
Fake briefs: Fraudulent job postings designed to collect personal information or advance payments from unsuspecting advocates.
Advance fee fraud: Requests for upfront payment before services are rendered, with no intention of delivering the service.
Impersonation: Scammers impersonating senior advocates, judges, or officials to gain trust or solicit money.
Fake fundraisers: Fraudulent condolence or fundraiser posts designed to collect money under false pretences.
Phishing: Messages or links designed to steal your account credentials or personal information.
Overpayment scams: A buyer "accidentally" sends too much money and asks you to refund the difference before the original payment bounces.
How to Protect Yourself
Verify LSK credentials independently for any advocate you engage;
Never share your login credentials, M-Pesa PIN, or banking passwords;
Be suspicious of urgent requests for money or personal information;
Verify information through independent channels before acting;
Report suspicious activity immediately.
Reporting Fraud
Report suspected fraud through the Platform's reporting feature or by submitting a support ticket. Include as much detail as possible: the user's profile, the nature of the fraud, any communications or transaction references, and screenshots. We will investigate all reports and take appropriate action, which may include account suspension and reporting to law enforcement.
Platform Liability
CounselConnect is not liable for any losses resulting from fraud or scams perpetrated by other users. We implement reasonable measures to detect and prevent fraud, but we cannot guarantee the elimination of all fraudulent activity.
13. Data & Account Safety
Use a strong, unique password. Do not reuse passwords from other services.
Enable two-factor authentication (2FA) if available.
Never share your account credentials with anyone, including people claiming to represent CounselConnect.
Log out on shared or public devices.
Report unauthorised access immediately by contacting support.
Review your privacy settings regularly. Control who can see your phone number, email, firm, location, and other profile information through your account settings.
Review connected applications. Periodically review and revoke access for any third-party applications connected to your account.
Keep your contact information current. Outdated email or phone numbers may cause you to miss important security notifications.
14. Advertising Safety
Advertisements are from third parties. Ads displayed on CounselConnect are from advertisers (including other Members and external entities). Their appearance on the Platform does not constitute endorsement by CounselConnect.
Verify advertiser claims independently. CounselConnect does not verify the accuracy or truthfulness of advertisements.
Report misleading ads. If you encounter an advertisement that is misleading, fraudulent, or violates professional standards, report it through the Platform.
Ad targeting. Ads may be targeted to you based on your profile, interests, and activity. See our Privacy Policy for details on ad targeting and how to manage your preferences.
15. Affiliate & Referral Safety
Affiliate links use tracking cookies. When you click an affiliate link, a tracking cookie is placed to attribute the referral. This is disclosed in our Privacy Policy.
Affiliates are independent. Affiliates are independent promoters, not employees, agents, or representatives of CounselConnect. Their claims and representations are their own.
Verify affiliate claims. If someone promoting CounselConnect makes claims about Platform features, pricing, or benefits, verify them directly on the Platform or by contacting support.
16. AI Chat Safety
AI responses are NOT legal advice and should not be treated as such.
AI-generated content may contain errors, inaccuracies, or outdated information (hallucinations). CounselConnect does not guarantee the accuracy of any AI-generated response.
Do NOT input confidential client information, privileged communications, or sensitive personal data into the AI Chat Service at chat.counselconnect.co.ke.
Always verify AI-cited cases and statutes against Kenya Law (new.kenyalaw.org) before use in any professional or legal context.
AI Chat is not a substitute for consultation with a qualified advocate.
CounselConnect is not liable for any reliance on AI-generated content.
17. Case Briefs Safety
AI-generated case briefs are summaries and may omit important details or nuances from the original judgment.
Always read the original judgment before citing or relying on a case brief in court proceedings.
Citation accuracy is validated by automated systems but is not guaranteed.
Report any errors or inaccuracies using the feedback feature on each brief at cases.counselconnect.co.ke.
Case briefs should not be submitted as legal research without independent verification against the original judgment on Kenya Law (new.kenyalaw.org).
